1. TERMS AND CONDITIONS

European Council Directive 97/7/EC provides rights to all consumers buying at a distance and this includes courses with us at ‘Learn English in Cornwall’. These regulations also ensure that all traders meet certain basic requirements. Included in this is clear contracting which means that both the consumer and the trader know what to expect and when – such as when a binding agreement is reached and what the terms and conditions are. This document is created especially with these aims in mind. Please contact Julie Tamblin direct should you wish to enrol or if you need a clearer explanation of anything described here.

What I offer you is a unique language learning package in beautiful surroundings. Whichever option you choose I will provide you with a quality, residential language-learning experience based on the learning package you choose. Please see my leaflet or web site for further details.

2. TERMS OF CONTRACT

2a. Your rights and responsibilities

Your responsibilities in this contract include providing sufficient information to ‘Learn English in Cornwall’to give you an excellent holiday and learning experience. To this end I have provided you with a booking form, please complete this in as much detail as possible. If you are the parent or guardian of an under 18 year old student booking with us, your responsibility includes supplying us with a current photograph of that student and sufficient information for me to be able to contact you at any time (if necessary) during their learning holiday.

You are also asked to make payments in good time and reminded that a late second payment for your learning holiday may result in a cancellation with no refund. Your payment schedule is clearly defined, as is your learning holiday. In the event of a payment default (eg failure of the student to make the second payment on time) Julie Tamblin has the right to end the agreement and treat the amount already paid as non-refundable. Please note that any costs resulting from cancellations or curtailments by the student are the responsibility of the student (or their guardian).

My students are encouraged to take full responsibility for their own learning experiences at ‘Learn English in Cornwall’ (but I remain flexible and open to student needs and aims). If students wish to make any major alterations to the courses they must inform me as soon as possible in writing, giving full details of the proposed changes. Due to the extra time involved in re-planning and re-sourcing courses these changes will incur an additional fee of £50 for administration, plus any other charges made by suppliers, for example, for special excursions.

All course materials are provided, but it is useful if students can bring their own language dictionary and school textbooks to help find a level and focus on individual needs. Your rights with ‘Learn English in Cornwall’ include a teaching programme tailored to your individual or group needs. They include a safe and peaceful environment in which to learn and a proper fulfilment of my teaching contract with you. Your rights as a student with ‘Learn English in Cornwall’ include your meals and accommodation provided as agreed, along with any other special requirements, such as extra teaching or specific excursions, agreed beforehand.

2b. My rights and responsibilities:

My responsibilities at ‘Learn English in Cornwall ’ include supplying you with a quality, language-learning holiday in one of the most beautiful parts of the UK . I aim to make the process of booking this as simple as possible, but there are legal obligations and regulations to protect the interests of both parties involved.

In brief, my responsibilities include providing you with a booking form and its terms and conditions in clear English. I also provide you with clear course descriptions and defined options for your courses. I also provide you with a clear payment process, pricing policy and schedule for this, in addition to printed receipts for all payments.

My rights within this contract include the right to be paid on time, the right to enjoy my time away from the teaching contract and privacy regarding my personal and family relationships. My rights also include the right to feel safe in my own home at all times and to be able to live peacefully according to my own values. Please note that course examples provided on the web site or in literature are only examples. I retain the right to be flexible in the delivery of courses at Learn English in Cornwall , including content, timing and teaching personnel.

3a. Details of payments

Payments for courses at Learn English in Cornwall are in two stages of 50%. The first deposit of 50% is made with the booking form with which you will be provided. This amount does not include any bank charges. These are the responsibility of the student (or their guardian). It does not include the administration fee.

The second payment should be paid to clear my account four weeks before your arrival so please make your deposit in good time for the banks to clear this payment. I will provide you with the date of your second payment along with the receipt for your first payment.

The precise details of my bank account will be provided to you on initial contact. When you decide to proceed with your quality language-learning holiday with ‘Learn English in Cornwall’, please contact me direct by mail, telephone or email, using my contact details provided.

3b. Late arrivals

My courses run within specified time frames. Late arrivals will not be compensated for by extensions or refunds of payments.

3c. Late Bookings

Normally bookings are made several months in advance. For any bookings made six weeks or less before the course begins, full payment will be required at the time of booking.

3d. Administration Fee

A one-off administration payment of £25 is due with the first deposit for courses at Learn English in Cornwall . This is to help cover outgoings such as office costs, stationery and phone costs, computer and website maintenance, marketing and legal costs.

4. CANCELLATIONS

4a. Consumers’ right to cancel

The consumer has a right to cancel within 7 working days of the initial contract with a full refund provided.

If the student cancels five weeks or less before the course start date the student loses the initial deposit.

If the student cancels in the period of 8 – 27 days before the course start date they also lose 70% of their second payment. If the student cancels 1 – 7 days before the course start date the student loses 100% of their second payment in addition to their first.

The first deposit of 50% remains non-refundable on the basis that the business needs to make preparations for the courses and reservation of time in advance. There are also administrative costs incurred. For this reason, it is essential that the customer insures themselves against any unforeseen circumstances that may lead to the cancellation of their learning holiday.

If courses are cancelled by either party, notice of the cancellation must be provided in a durable medium, e.g. by mail or fax in addition to email or telephone. The date of cancellation will be the date of receipt of the letter or fax of cancellation. The cancellation itself must be in writing by the person who signed the booking form or made the online order.

4b. Trader’s cancellation of contract

In the event of cancellation of courses by the trader, a full refund of both deposits is provided to the customer. In the event of a cancellation ‘Learn English in Cornwall ’ will inform the student before the start date of the course and as soon as reasonably possible. A revised date can be agreed but the student has a right to refuse an alternative date and treat the contract as if it never existed (ie all monies must be refunded by Learn English in Cornwall in the event of their cancellation, within 30 days including any postage costs). Cancellations by Learn English in Cornwall will be confirmed by letter or fax.

5. INSURANCE

Travel insurance is essential when booking a holiday abroad. A comprehensive travel insurance will help to protect you in the event of sickness or injury, personal loss and cancellation due to unforeseen circumstances. Unforseen circumstances are a regular occurrence in today’s world. These may include such things as changing circumstances, extreme weather conditions or the effects of terrorism. It is clearly your responsibility to insure yourself against the loss of your holiday through unforeseen circumstances. A comprehensive insurance policy covers cancellation and curtailment, medical emergencies and associated expenses, personal accident, personal belongings, loss of passport and personal money, missed departures, departure delay, personal liability, hijack, mugging, catastrophe cover, homecare and legal advice and expenses.

For countries in the European Economic Area and Switzerland , the European Health Insurance Card (EHIC) is an essential addition to your insurance. This card entitles you to reduced cost, (sometimes free), medical treatment in most European countries.

6. LOCAL POLICIES

6a. Public holidays policy

Course fees at Learn English in Cornwall are derived from the number of ‘learning days’ plus weekend accommodation charges. Lessons will continue on British Bank Holidays so these will not effect course fees. Lessons on Saturdays are negotiable. Lessons are not provided on Sundays or Christmas Day.

6b. Household policies

Green household : Visitors are expected to respect and support my efforts to care for the planet. This could mean for example giving careful consideration to the use of energy and resources in my home and in the local environment, the careful recycling of waste etc.

Smoking : This is a non-smoking household.

Mobile phones : Please restrict your use of telephones in consideration of other members of the household. Generally please take telephone calls in your bedroom with the door shut rather than in shared spaces.

Noise : Please keep noise, such as music, DVD or video to a minimum after 10pm

6c. Behaviour

My courses take place in an atmosphere of mutual respect, honesty and goodwill. Whilst I work to resolve any problems which may arise, for example due to cultural differences,
